We all need some non-hurricane news, so how about a lawsuit over “improper towing” near the Florida State University campus? You’ll take it? Good.
Leon County resident Charles Coshatt is mad as hell over being towed from the Zaxby’s fast food restaurant on West Tennessee Street, and he’s not going to take it anymore.
He filed a proposed class-action lawsuit for himself and others with cars wrongly hauled off the eatery’s lot — 151 vehicles in all — over the last four years, according to his complaint filed this week.
On Aug. 5, he parked his 2007 Dodge pickup at the restaurant at around 2:15 a.m., and was towed about 15 minutes later, his complaint says.
His attorney, Jaeson Homola of Tallahassee’s Barrett, Fasig & Brooks law firm, explained that Coshatt only intended to park there for a short time because he was a “designated driver,” picking up a buddy who had been out drinking.
Coshatt said the towing violates a state law governing the removal of parked vehicles from private property because, in part, there were no signs saying the lot was a tow-away zone.
He claims a “monetary loss” and seeks unspecified damages, costs and attorney fees.
The suit is against Real Chick, Inc., the operator of the West Tennessee Street Zaxby’s. A corporate representative did not respond to a message.
