A hand-delivered demand letter from a Jacksonville law firm representing one of Jacksonville’s solid waste hauling companies, Republic Services, to Jacksonville’s solid waste division and office of General Counsel charges that the city of Jacksonville has collected “in excess of $600,000 in payments to which it is not entitled” from the city since June, 2015.
In June, Republic, “consistent with the terms of the processing contract, began deducting the amount paid to the city for program recyclables by the amount of non recycling residue consistent with the materials.”
The city, says the letter, “contests this action” but now requests that “these last three past payments be made as a precondition to resolving this dispute.”
The city is also accused of “short-paying” Republic, “by the amount Republic has deducted from payment to the city under the Processing Contract for the non-recyclable residue.” Republic claims to have been underpaid in August and September, which puts the city in breach of contract in its eyes.
As well, there is a corollary dispute over $35,359, which Republic “mistakenly overpaid” Jacksonville for “inadvertently commingled” recyclables from Neptune Beach in June.
Republic wants that money back, in addition to $63,698 which they claim to be owed.
While Republic is open to “good faith negotiations,” they clearly want to get what they believe is due to them, and are interested in ceasing “overpayment.”
