Eureka Garden in default of HUD contract

A December 10 letter from HUD broke the news: Eureka Garden is in default of its HUD Housing Assistance Payments contract.

The reason for default: failure to maintain facilities, as amply documented throughout the media. including failure to provide “decent, safe, and sanitary housing” and keep units in “good and tenantable condition” in accordance with HUD standards.

The letter cites the October inspection, which found 340 of the 400 units in the complex to be non-compliant, with 50 presenting “exigent health and safety concerns.”

The letter also mentions air quality issues found in November, such as mold and natural gas leaks.

The ownership has until February 4 to rectify these issues, and to receive the “Project Owner’s Certification” to prove it.

If not? HUD could take possession of the property.
