Gov. DeSantis has a ‘big problem’ with Florida legalizing recreational pot

Florida’s Governor is voicing concerns about a potential citizen’s initiative that could legalize recreational pot.

But it seems some of his concerns are misguided, as he doesn’t seem to fully understand the potential constitutional amendment based on some of this comments.

Addressing reporters after Sine Die in Tallahassee, Gov. Ron DeSantis suggested that the proposed language was too broad and left openings for quality-of-life infringement, but misrepresented the proposal.

“I looked at that language and, I mean, it is the broadest language I think I’ve ever seen, basically nobody could ever be regulated or penalized in any way for possessing or using this. I mean, what, you can’t regulate it near a school? You can’t tell people you can’t smoke?” DeSantis said.

“It seems to supersede any other regulatory regime that we have and that means that if that were to come to pass that people in the downtown areas, in different communities, this is going to be part of your community.”

He then complained about the possible effects.

“I’ve gone to some of these cities that have had this everywhere, it smells, there’s all these things,” DeSantis said.

“So from a quality of life perspective, if you can’t do time, place and manner restrictions, that is going to impact every Floridian in one way or another. And I just think it’s so incredibly broad that I think that provision is particularly problematic.”

The Governor suggested that there may be a difference between usage by “people in their homes, like we got a lot of things to worry about” and walking “in front of shops and having this.”

“I don’t want every hotel to really smell. I don’t want all these things, but if you’re saying you can’t regulate it or you can’t limit it — which, that’s how I read that — that could be a big, big problem.”

Smart and Safe Florida, the campaign driving the potential adult-use question, notes that in fact the amendment addresses the Governor’s concerns regarding guardrails against outdoor smoking and vaping.

“We agree with Governor DeSantis and do not want Florida to become like California and New York where public outdoor smoking is prevalent. This is exactly why we added language giving the Florida legislature the authority to limit outdoor and public consumption just like Florida already does for smoking tobacco products.”

Indeed, the language stipulates “nothing in this amendment prohibits the Legislature from enacting laws that are consistent with this amendment.”

DeSantis has predicted that the Florida Supreme Court would approve the Adult Personal Use of Marijuana citizen initiative that could lead to a constitutional amendment for voter consideration, with legalization in effect as soon as May 2025 if 60% or more of voters approve.

His opposition to the amendment follows the lead of Attorney General Ashley Moody, who has cited law requiring constitutional amendments to touch on just a single subject, and expressed doubt about whether this one complies with all technical requirements of state law.

DeSantis has said he opposes legalization for a variety of reasons, including saying today’s product is “too potent” and that dealers can “throw fentanyl in” while on the campaign trail last year during his presidential campaign.

Early in his first term in office, DeSantis pleased reformers when he came out against the Rick Scott-era opposition to cannabis that could be smoked. Previously, loose flower was not available, with only vaporizer cups for sale at dispensaries.

“I look at someone who has Lou Gehrig’s disease or terminal cancer or multiple sclerosis. … I think the Florida voters who voted for that wanted them to have access to medical marijuana under the supervision of a physician. Whether they have to smoke it or not, who am I to judge that?” DeSantis said. “I want people to have their suffering relieved. I don’t think this law is up to snuff.”

However, the Governor has taken a harder line against marijuana in recent years.

“If you look at some of the stuff that’s now coming down, there’s a lot of really bad things in it. It’s not necessarily what you would’ve had 30 years ago when someone’s in college and they’re doing something. You have some really, really bad stuff in there, so I think having the ability to identify that, I think, that’s safety, and quite frankly when you get into some of that stuff, it’s not medicinal at that point for sure,” DeSantis said, in response to a reporter’s question in 2021.

        The “War on Cannabis” has been a complete and utter failure. It is the largest component of the broader yet equally unsuccessful “War on Drugs” that has cost our country over a trillion dollars.

        Instead of The United States wasting Billions upon Billions more of our yearly tax dollars fighting a never ending “War on Cannabis”, lets generate Billions of dollars, and improve the deficit instead. Especially now, due to Covid-19. It’s a no brainer.

        The Prohibition of Cannabis has also ruined the lives of many of our loved ones. In numbers greater than any other nation, our loved ones are being sent to jail and are being given permanent criminal records. Especially, if they happen to be of the “wrong” skin color or they happen to be from the “wrong” neighborhood. Which ruin their chances of employment for the rest of their lives, and for what reason?

        Cannabis is much safer to consume than alcohol. Yet do we lock people up for choosing to drink?

        Let’s end this hypocrisy now!

        The government should never attempt to legislate morality by creating victim-less cannabis “crimes” because it simply does not work and costs the taxpayers a fortune.

        Cannabis Legalization Nationwide is an inevitable reality that’s approaching much sooner than prohibitionists think and there is nothing they can do to stop it!

          Totally agree. My husband has a card but the oils and flower and vape has helped him more then opioids. He feels better mentally and is pain free. Let’s get this passed. We can’t smoke in allot of places so what’s the big deal?

      My first ALS symptom occurred in 2016, but was diagnosed in 2018. I had severe symptoms ranging from shortness of breath, balance problems, couldn’t walk without a walker or a power chair, i had difficulty swallowing and fatigue. I was given medications which helped but only for a short burst of time, then I decided to try alternative measures and began on ALS Formula treatment from Aknni herbs centre, It has made a tremendous difference for me (Visit ww w. aknniherbscentre.c om). I had improved walking balance, increased appetite, muscle strength, improved eyesight and others.

Yes, some people are responsible but, others only car fore their personal desires with no regard for the safety of others. There must be control over any item/s that endanger others through abuse.     If it’s legalized then it needs to be use at home/fixed location only, but not in public. I don’t care what you do in your home, but I need to be able to walk into the grocery store without being attacked by your weed. I have stopped going to businesses where you just can’t walk in the door without it reeking. I won’t go to a restaurant where it smells either of cigarettes or weed. And I’m sick of being afraid to drive because of the number of people driving under the influence weaving all over the road. My partner’s car was totalled (while parked) by some rich old lady who was high as a kite, and sideswiped another time by a woman who was clearly stoned and then sued to pay for her spa vacations. Yes they caught her for fraud after the fact. Damage was done. Both times the cops did nothing. If they legalize it without restrictions, I don’t want to live here anymore because the people in Florida are just not mature or respectful enough to handle it like adults. And yes, I feel the same about alcohol. It all needs to be do what you want at home, or securely in a home or fixed location, and act right in public, the end. Go ahead and hate me.

      Stores, businesses, schools, government agencies and etc. that don’t permit cigarette smoking can easily expand their prohibition to pot.

      Smoking is smoking, and non-smokers will continue to have the right to voice their opposition to public smoking.

      If you actually feel the same way about alcohol, then you would have left Florida a long time ago. (Pot may actually reduce alcohol consumption.)

    I like to light up a big sticky joint every now and then. I have my own business, wife, kids… total suburban dad. I am very discreet and I would be devastated to be arrested and charged… I am not a criminal..I dont mind regulation on where, no one wants to be overpowered by the smell and it should not be around kids.

    I don’t think it’s unreasonable to expect people to follow rules of common courtesy in public and be safe drivers. You seriously have a problem with that? But then also be able to do, smoke, drink, or grow whatever they want to in their own homes or private or designated places as long as it doesn’t hurt children or cause a hazard or cost taxpayers money to clean up. It’s not rocket science, people. It’s common sense. Swing a bat any direction you like as long as it doesn’t hit someone else. Laws get pushed and passed because too many people act like fools and open the door for government big footing and fear mongering.

    You guys want to talk about the morality and politics of cannabis but the reality of what you’re up against is pure business and profits. See, keeping marijuana illegal in certain channels is a huge business—for politicians, lobbyists, aspects of the judicial system, prisons, drug testing, etc. Prohibition is an industry. Likewise, the corporations who have paid enormous licensing fees for exclusive medical cannabis programs expect protectionist policies from the politicians who they help get elected, and they won’t give up that easily. Those licensures are vertically integrated soup to nuts to protect their interest in the market and against any competition. Look at the hemp bill that just passed which was to squash any competitor with dispensaries. If you look at the patchwork of laws across the country, you can see it’s based on the structure of business within those states. Even if it’s fully legalized at the federal level states can still set their own restrictions. So really you know, it’s not about the values argument, it’s just business. Alcohol taxes are a huge source of revenue so don’t expect to see that go away. Logic would assume the same for cannabis, especially in light of lower alcohol consumption rates by younger generations and the popularity of cannabis, but the politics are not as logical due to the protectionist policies and industry siloes. Unless something happens to change that drastically, it will change incrementally as the millennials and younger gens take over the heavier voting blocks. Their turnout is still pathetic, so you get what you get.

    I lived next-door to what my daughter referred to as Schafers. All they did was sit on their front porch and realize most of our weather is hot and humid but on the nice days when I could open my front window, the weed smell would come in my unit and it was disgusting. I also had children sleeping napping in my living room that had to endure that smell. It also travels through the vents of the air conditioning in multi dwelling units. Let me fast forward to my high-end hotel stays where you walk down the corner and you smell nothing but weed in the elevators. It gets you thinking since I did enjoy a little weed back in the day, I don’t wanna talk to people that are high all the time it does not smell nice, and the people that live next-door to me they were nonproductive people they were horrible to their children. They paid more attention to their weed consumption than they did keeping the property clean, and their children happy , so no we don’t want another New York City. Been there disgusting everywhere you go while you smell is pot lethargic society no thank you

    We live in the dark ages thinking weed should be banned. I too think it smells like a skunk, but I have read that is only some varieties. Marijuana should be legally regulated and taxed, the monies it would provide could help our State in hundreds of ways. It should be illegal to drive stoned, or provide it to a minor. The areas where it could be smoked should be limited just as cigarettes or cigars. The number of people who favor legalization far out number the number who do not.
    The current politics of fear mongering are just that, fear mongering.
    Florida government has MANY other things it should be working on, not pot, not what some company has the right to say to it employees. Time for citizens to take notice of what our government claims we want.
    We screwed up, we will have to stay vigilant and imformed until the time comes to remove this group from Tallahassee.

Teachers, moms, dads, people you know from church. It’s so common and prevelant that it would blow you mind. Get over it, and stop criminalizing it already.

    Not sure what the deal is regarding Florida’s proposed law regarding legalization of marijuana. All they have to do is copy existing law in any number of the dozens of states that have already legalized it. There shouldn’t be any obvious holes in the law or ambiguity.

    ALS is a cruel disease. My mum is 83 and had great difficulty speaking and swallowing much of anything. Food was getting trapped in her throat and blocking her air way was happening more often. she battled for each breath. The riluzole did very little to help her. The medical team did even less. Her decline was rapid and devastating. The psychological support from the medical centre was non-existent and if it were not for the sensitive care and attention of our primary physician, there she would have died. There has been little if any progress in finding a cure or reliable treatment. Acupuncture eased her anxiety a bit. this year our primary physician started her on Natural Herbs Centre ALS/MND Ayurvedic treatment, 6 months into treatment she improved dramatically.
