Jacksonville City Councilman wants Pam Bondi’s opinion on local regulation of vape devices

Jacksonville City Councilman John Crescimbeni introduced a resolution Tuesday night that would solicit the opinion of the State Attorney on local regulation of nicotine vapes.

The specific question to be considered via 2018-282: “Whether the City of Jacksonville has the ability to regulate the sale of nicotine products and nicotine dispensing devices” as reflected by Florida Statute 877.112.

That statute deals with e-cigs and electronic vapes, and Crescimbeni would like clarity on that, he told us Wednesday.

While it is uncertain what the end game of getting clarity on that subject is, it’s worth noting that the councilman filed a bill last year (2017-211) in support of twin bills in the Florida Legislature that would urge Florida to become a so-called Tobacco 21 state.

The proposals (SB 1138 and HB 1093) did not pass.

The councilman’s logic: a ban on sales to those under the age of 21 would help to keep tobacco products out of the hands and lungs of those under the age of 18, as those over 21 aren’t typically “mingling” with minors.
